Terms of Service
These Terms of Service ("Terms") govern your access to and use of Terrain, a revenue intelligence platform operated by Techsoftnexa LTD ("TechSoftNexa", "we", "us", or "our"), a company registered in Ghana. By creating an account or using Terrain, you agree to be bound by these Terms.
1. The Service
Terrain is a software-as-a-service (SaaS) platform that provides revenue intelligence, dynamic pricing recommendations, demand forecasting, and channel optimization tools for luxury hospitality and experience operators ("the Service").
The Service is provided via getonterrain.com and is operated by Techsoftnexa LTD.
2. Account Registration
To use Terrain, you must create an account by providing a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must provide accurate, current, and complete information during registration. You may not share your account with others or create accounts for the purpose of misuse.
3. Free Trial
New accounts receive a 90-day free trial with full access to the Service. No credit card is required to begin the trial. At the end of the trial period, continued access requires a paid subscription.
TechSoftNexa reserves the right to modify or discontinue the free trial offering at any time.
4. Subscriptions and Payment
Terrain subscriptions are billed monthly in US Dollars (USD). Subscription tiers are:
- Founding Lodge — $299/month (unlimited suites, Growth-level features, rate locked for 12 months — available to the first 50 lodges only)
- Starter — $299/month (up to 15 suites)
- Growth — $599/month (up to 35 suites)
- Portfolio — $999/month (36+ suites or multiple properties)
Payment is processed securely through Paddle, our payment provider. By subscribing, you authorise Paddle to charge your payment method on a recurring monthly basis.
Founding Lodge subscribers are locked into the $299/month rate for 12 months from their subscription start date. After 12 months, the rate will revert to the standard plan pricing in effect at that time. The Founding Lodge plan is limited to the first 50 subscribers and may be withdrawn at any time once that limit is reached.
5. Cancellation and Refunds
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.
Upon cancellation, your data remains accessible for 30 days, after which it may be permanently deleted.
6. Your Data
You retain full ownership of all data you input into Terrain, including lodge details, package information, pricing configurations, and revenue goals. TechSoftNexa does not sell, share, or use your operational data for any purpose other than providing the Service.
We may use anonymised, aggregated data to improve the Service and generate industry benchmarks. No individual lodge data is ever identifiable in such aggregations.
7. Acceptable Use
You agree not to use Terrain to:
- Violate any applicable law or regulation
- Attempt to gain unauthorised access to other accounts or systems
- Reverse engineer or attempt to extract the source code of the Service
- Use the Service for any purpose other than legitimate hospitality revenue management
8. Intellectual Property
Terrain and all associated software, designs, algorithms, and content are the intellectual property of Techsoftnexa LTD. Nothing in these Terms grants you any rights to the underlying technology or brand.
9. Disclaimer of Warranties
Terrain is provided "as is" without warranties of any kind. Revenue recommendations and forecasts are provided for informational purposes only. TechSoftNexa does not guarantee specific revenue outcomes from use of the Service.
10. Limitation of Liability
To the maximum extent permitted by law, Techsoftnexa LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 3 months preceding the claim.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of Ghana. Any disputes shall be resolved in the courts of Ghana.
